Maintenance benefits will be paid to a woman from the day of submission of a claim to the National Insurance Institute, and retroactively for a year at most.
Payment for the period that preceded submission of the application is made upon the woman's express request, provided that she did not receive any payment from the debtor during the retroactive period claimed, and did not initiate any collection proceedings against the debtor through the Enforcement and Collection Authority.
The maintenance payments will be made as long as no subsequent court judgment for maintenance is issued that nullifies or changes the content of the preceding judgment, and as long as the other conditions of entitlement are still met.
Payment for children
Payments will be made for each child included in the court judgment until he reaches the age of 18.
Judgment determining one amount for all children - when each one of them turn 18 - their proportional share will be deducted from the amount specified in the court judgment.
Judgment that specifies one amount for a woman in divorce proceedings and the children - when each one of them turn 18 - their proportional share will be deducted from the amount specified in the court judgment.
When the woman is divorced effectively - her proportional share will be deducted from the amount specified in the judgment.
Important! In some cases, according to the court decision, maintenance benefit can be paid to a child even after reaching the age of 18.
